Sometimes, during research, we come up with or stumble upon something that is not only unique, interesting and scientifically important, but also has possible commercial viability. The question you might then ask is, ?Can I patent it?? ?In other words, ?Can I legally protect the intellectual property that I have created so that I have exclusive rights to pursue it for financial gain?? and ?If I patent something, what rights will that grant??

Unless you have already gone through the patent process you likely don?t have answers to these questions. Recently, a patent attorney - Jeremy Stipkala Ph.D., J.D., who has his own legal practice called Stipkala Law - visited the Meyer research group to help answer these questions. Jeremy received his Ph.D. in chemistry from Johns Hopkins University and then went on to get his J.D. from George Washington University Law School. His expertise allows him to share insight into the patent process from both a scientific and a legal perspective. He gave us a straight forward handout to provide some insight into the patent process. With his permission, I am now sharing this handout with you.

I have heard (not from Jeremy) several additional suggestions, tips and factoids relating to patents. I would like to share them with you:

- It is important to perform a cost-benefit analysis before pursuing a patent. Only a small percentage of patented ideas ever become commercially available and even a smaller percentage make money. The process of obtaining a defensible patent (explained in greater detail below) can be expensive ($25,000-30,000 in the US). Unless your potential return on investment is high, it might not be worth pursuing a patent.

- Getting a patent is the relatively easy part of the process (for example, a number of physically impossible patents have been issued over the years). The real test of a patent is whether or not it's defensible - i.e. will you win if a competing company decides to challenge your patent in court? The strength of you patent rests on a combination of how well the patent is written and your record of invention (your lab notebook). In this instance, a well-kept lab notebook can literally be the difference between millions of dollars and nothing.

- Try to avoid unnecessary commentary about the patent in email correspondences. If the patent is challenged in court, your email record could be used as evidence. For example, if you include comments like ?I don?t think we can patent this idea.? the challengers could argue that you didn?t even support your own patent.

-The protection of intellectual property is covered in the United States Constitution in what is known as the Copyright Clause (Article I, Section 8, Clause 8). This says:

?To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries.?

-Prior to 1980, any intellectual property produced from government-funded research in the United States was the property of the government. Under these rules the government accumulated 28,000 patents. Some argued that government ownership of these patents stifled the financial incentive for federally-funded researchers to create businesses. The passage of the Bayh-Dole Act in 1980 was an attempt to remedy this possible short-coming. One of the greatest impacts of the Bayh-Dole act was that U.S. universities, small businesses and non-profit organizations could own intellectual property created under federally-funded research (with several qualifiers). This is the reason many professors have created their own companies.

-One interesting provision of the Bayh-Dole act is that it grants the government march-in rights. Despite the intellectual property being owned by the original applicant, the march-in right allows funding agencies to basically ignore the exclusivity of the patent and grant a license to others in special circumstances. While no federal agency has yet exercised march-in rights, it is something to be aware of.

-There are two different policies that govern who can claim ownership of intellectual property: first-to-invent and first-to-file. Under the first-to-invent rule, the person who can prove they came up with an idea first is the owner, regardless of who obtained the patent first (This decision is usually based on the first written record of the idea). Under a first-to-file policy it does not matter who came up with the idea first, only who filed the patent application first. Currently, the United States is one of a few countries that practice the first-to-invent rule. However, starting on March 16th, 2013 the US will change to a first-to-file policy thanks to the passage of Leahy-Smith America Invents Act. Hopefully, this law will simplify the patent process and reduce the amount of time spent in court trying to prove who was the first-to-invent.

Hackers apparently hit Swedish government site

A group linked to the hacker network Anonymous on Saturday said it had attacked the Swedish government's website, bringing it down for periods of time by overloading it with traffic.

CyberForce used Twitter to claim responsibility, saying "We have succeeded in the attack against the government."

It also indicated it may launch more attacks at around midnight (2300 GMT) Saturday, saying "this op starts at 24.00," but it was not immediately clear who the targets for those attacks may be.

The group said it had used a denial of service attack against the government, which essentially swamps a website with false users.

Government spokesman Jacob Lagercranser confirmed the website ? used by all departments of Sweden's government ? had experienced some problems, but he declined to give further details, saying the government never comments on security issues.

"Periodically we've experienced some problems in getting in on it. We're working on the problems," he said. The site was up and running again later Saturday.

CyberForce describes itself as part of the hacking collective Anonymous, which drew international attention by hacking onto a private conference call by the FBI and Britain's Scotland Yard, then publishing the roughly 15-minute-long recording of the call on the Internet on Friday.

In the past week, Saboteurs have stolen passwords and sensitive information on tipsters while hacking into the websites of several law enforcement agencies worldwide.

Now a new study suggests we could get the equivalent of large resveratrol doses from pills we already have? a class of drugs that are being tested for use as treatments for Alzheimer's and Parkinson's disease.

The findings suggest these drugs, known as known as phosphodiesterase type 4 (PDE4) inhibitors, may provide a practical way to reap red wine's benefits than consuming buckets of the stuff (which would certainly carry health risks).

"[The study] reveals a novel utility for this class of drugs that hasn?t been explored before," said study researcher Dr. Jay H. Chung, chief of the Laboratory of Obesity and Aging Research at the National Heart, Lung, and Blood Institute.

However, the study was conducted in mice, and the results will need to be replicated in people.

Why red wine is healthy

In the study, scientists aimed to figure out exactly how resveratrol, a compound in red wine, acts inside cells. They discovered resveratrol works in a different manner than previously thought.

The study showed that resveratrol inhibits a protein known as phosphodiesterase type 4 (PDE4).That meant that resveratrol is a PDE4 inhibitor.

Knowing that drugs called PDE4 inhibitors werebeing tested to treat Alzheimer's, the researchers gave one such drug, called rolipram, to mice.

They found the drug produced all the health benefits of resveratrol, including preventing diet-induced obesity and improving control over blood sugar levels.

In studies on people, resveratrol has been shown to have anti-diabetes effects. But people would need to consume about 1,000 bottles of red wine a day in order to take in enough resveratrol to see true health benefits, Chung said.

PDE4 inhibitors could provide a realistic way for people to get the same benefits, the researchers said. In addition, PDE4 inhibitors may be less toxic than resveratrol itself, because the compound interacts with many proteins inside cells.

"By just targeting the key player [PDE4] you minimize the potential for adverse effects," Chung said.

Chung said he is planning to conduct a follow-up study that examines the effects of rolipram on obese people with insulin resistant.

Another PDE4 inhibitor, called roflumilast, is already approved as a treatment for people with chronic obstructive pulmonary disease (COPD). The side effects of this drug include diarrhea, nausea and dizziness, according to the National Institutes of Health.

Treating diseases

"I think this is a huge step forward in the understanding of what resveratrolcan do at the biological level," said Philippe Marambaud, an Alzheimer's researcher at the Feinstein Institute for Medical Research in Manhasset, N.Y., who has researched resveratrol and was not involved in the new study.

By finding out how resveratrol works, the study helps researchers who are investigating whether the compound can have therapeutic effects for other diseases, such as Alzheimer's disease, Marambaud said.

However, future studies will need to replicate the findings to be sure that resveratrol does indeed inhibit PDE4, Marambaud said.

In addition, although the study suggests PDE4 inhibitors can mimic resveratrol,. researchers should continue investigating the effects of resveratrol, as well as those of PDE4 inhibitors. "You don't want to think that one approach will work better than another," Marambaud said.

The new study will be published Feb. 3 in the journal Cell.

COLORADO SPRINGS, Colo. ? With 120 lions, tigers and other big cats on the grounds, the owner of a Colorado refuge didn't think he needed a security system.

Nick Sculac says he changed his mind after two January break-ins at Serenity Springs Wildlife Center, 20 miles east of Colorado Springs.

The Colorado Springs Gazette reports ( http://bit.ly/xZJT6H) someone scaled a 10-foot fence lined with barbed wire and cut a hole in a cage, letting three tigers out. Workers found the tigers roaming the compound the next morning.

Days later, employees arriving for work found two people inside the compound trying to pet a cougar through its cage. Sculac says they scaled the outer fence and drove away.

Sculac says nobody was hurt. He says he hired a guard and is shopping for a security system.

Obama details broader housing plan (AP)

FALLS CHURCH, Va. ? President Barack Obama called on Congress Wednesday to make it easier for millions of additional homeowners to refinance their mortgages at lower interest rates even if they owe more than their homes are worth. He conceded that his administration's housing plans so far have not lived up to their promise.

Calling the housing problem "massive in size and in scope," Obama detailed a proposal he outlined in his State of the Union speech last week, tackling an issue of vital concern in states key to his re-election.

"This housing crisis struck right at the heart of what it means to be middle class in America: our homes," Obama said, speaking at a northern Virginia community center.

Obama's proposal would give homeowners with privately held mortgages a shot at record low rates though a new government program, for an annual savings of about $3,000 for the average borrower.

The program is the latest administration effort to help homeowners in the face of a massive number of foreclosures and plunging house values that have left millions of borrowers owing more than their homes are worth. The administration plan aims to ease the way toward refinancing for borrowers, who despite good credit have been unable to take advantage of lower rates because they are underwater on their loans or because banks fear they will be left taking losses.

The administration has rolled out housing programs before with the hope of helping millions of struggling homeowners. But those initiatives have fallen short.

"I'll be honest, the programs we've put forward didn't work at the scale we'd hoped," Obama said. "Not as many people have taken advantage of it as we wanted."

The housing issue, while national in scope, resonates particularly in election battlegrounds like Nevada and Florida which have faced record foreclosures. Obama himself drew attention to the politics surrounding the issue with an indirect jab at former Massachusetts Gov. Mitt Romney, now the front-runner in the Republican presidential contests. Romney in October suggested the foreclosure process should "run its course and hit the bottom."

Without naming Romney, Obama said: "It is wrong for anyone to suggest that the only option for struggling, responsible homeowners is to sit and wait for the housing market to hit bottom. I refuse to accept that, and so do the American people."

The administration proposal faces a major hurdle in Congress. The program would cost between $5 billion and $10 billion, depending on participation, and the administration proposes to pay for it with a fee on large banks. The administration has tried unsuccessfully before to win support for such a tax on large banks. Administration officials, however, said Obama would consider other ways to pay for the program.

The plan would expand the administration's Home Affordable Refinance Program, which allows borrowers with loans backed by government-affiliated mortgage giants Fannie Mae and Freddie Mac to refinance at lower rates. About 1 million homeowners have used it, well short of the 4 million to 5 million the Obama administration had expected. Moreover, many "underwater" borrowers ? those who owe more than their homes are worth ? couldn't qualify.

The administration estimates that 3.5 million borrowers with privately-held mortgages have high enough interest rates that they would have incentive to refinance under the new plan. That's in addition to 11 million borrowers who have Fannie- or Freddie-guaranteed loans who could be eligible for refinancing under the administration's proposed changes.

About 11 million Americans ? roughly 1 in 4 with a mortgage ? are underwater, according to CoreLogic, a real estate data firm.

Half of all U.S. mortgages ? about 30 million home loans ? are owned by nongovernment lenders.

The new administration plan would permit homeowners to refinance their mortgages into loans backed by the Federal Housing Administration. To qualify, borrowers with privately held mortgages would have to have no more than one delinquency in the six months preceding refinancing. Their loans would have to fall within the mortgage limits set by the FHA in their home counties.

The administration would encourage borrowers to apply their savings directly toward lowering the principle of their loans instead of reducing their monthly payments. As an incentive, borrowers who choose to rebuild equity would not have to pay closing costs and would have to agree to refinance into a loan with a 20 year term or less with monthly payments roughly equal to those they make under their current loan.

Obama also announced new industry standards for mortgage servicers, a sort of "bill of rights" for borrowers that would protect them in their transactions. During his remarks, Obama brandished a simpler, three-page loan document to illustrate the new standards.

The administration will also undertake a program that would allow the sale of foreclosed homes by Fannie Mae to investors who would then offer the properties for rental. Administration officials say there is a high demand for rental housing and such a program would also sustain neighborhoods by keeping foreclosed homes from falling into disrepair.

EU probes Samsung, Germany blocks its tablets (AP)

BRUSSELS ? Samsung took a double-hit in its battle against archrival Apple when the European Union announced it would investigate whether it was illegally trying to hinder competitors and Germany blocked sales of some of its tablet computers.

Samsung Electronics and Apple Inc. are engaged in a strategic war over patents in many countries across the world as they try to draw market share away from each other.

The EU's antitrust watchdog thinks the South Korean company may be overstepping the bounds and launched a formal investigation into whether Samsung is using lawsuits over key patents on 3G wireless technology to hinder competitors ? including Apple.

The European Commission, which is acting as the EU's antitrust enforcer, said Tuesday it suspected Samsung of not giving other companies fair access to patents it holds on standardized 3G technology for mobile devices ? despite committing to do so in 1998.

A spokeswoman for the Commission said the probe also affected tablets such as Apple's newest iPad, which uses standardized wireless 3G technology.

The Commission said that Samsung last year sought legal injunctions against other device makers in several EU states, alleging patent infringement.

Under EU patent rules, a company that holds patents for standardized products is required to license them out indiscriminately at a fair price.

If Samsung is found guilty of unfairly restraining competition, it can be fined up to 10 percent of annual revenue related to the investigation.

"Samsung now has to think carefully about how it wants to deal with (the probe)," said Florian Mueller, a patent analyst who has been closely following the battle between Samsung and Apple.

In the EU, Samsung has sued Apple in Germany, France, Italy, the U.K., the Netherlands and Spain. It also has legal proceedings against its competitor in the U.S., South Korea, Japan and Australia, Mueller said. However, Mueller said, Samsung may now be inclined to withdraw its lawsuits against Apple following news of the European investigation.

The battle between the two companies began in April, when Cupertino, California-based Apple sued Samsung in the United States, alleging the product design, user interface and packaging of Samsung's Galaxy devices "slavishly copy" the iPhone and iPad.

Samsung ? the global No. 1 in TVs and No. 2 in smartphones by sales ? responded by filing its own lawsuits that accused Apple of patent infringement of its wireless telecommunications technology.

A spokesman said the European Commission launched its probe after its own investigation of the market, rather than reacting to complaints from Samsung's competitors. However, the Commission last year sent antitrust questionnaires to both Apple and Samsung.

The spokesman added that similar probes could also be launched against other companies strategically using patent lawsuits to stop competitors from selling similar devices.

Nam Ki-yung, a spokesman at Samsung Electronics in South Korea, said his company was looking at details of the news on the probe but had no immediate comments.

EU antitrust probes don't have a deadline and the Commission stressed that its investigation does not mean Samsung did indeed breach the bloc's competition rules. Samsung now gets the chance to respond to the Commission's concerns, as will other market participants.

Also Tuesday, in a separate case, an appeals court in Germany ruled in favor of Apple, saying Samsung could not sell its Galaxy Tab 10.1 nor the Galaxy Tab 8.9 in the country because they too closely resembled the iPad2, in violation of unfair competition laws.

"Samsung wrongly used the enormous reputation and prestige of the iPad," Duesseldorf state court Presiding Judge Wilhelm Berneke wrote in his ruling.

Samsung's successor tablet, the Galaxy Tab 10.1 N, was not affected by the ruling, and the company said that while the decision was disappointing, it was largely irrelevant.

"Today's ruling is of little factual relevance due to the new model Galaxy Tab 10.1 N, and ... the decision therefore is of no indicative value with respect to other legal proceedings involving the Galaxy Tab 10.1 N," Samsung said in an email to The Associated Press.

"Samsung will continue to take all appropriate measures, including legal action, to ensure continued consumer access to our innovative products."

Mueller concurred that the German court ruling won't have a commercial impact on the South Korean company, since it has already been selling a new model of the Galaxy tablet since November.

"The defeat in Germany is more of a symbolical nature," said Mueller, whose clients include Apple competitor Microsoft.

The probe and victory in the German court for Apple come after the California company has met with several setbacks recently in its fight with Samsung.

Most recently, a Dutch court ruled on Jan. 24 that Samsung's Galaxy Tab tablet was not a copy of Apple's iPad, and that it could continue to be sold in the Netherlands. That came on the heels of a December decision in Sydney, where the High Court dismissed Apple's appeal and said Samsung was free to sell its Galaxy tablet computers in Australia.
